A coalition of Texas bookstores and national booksellers associations filed a lawsuit Tuesday challenging Bill 900, which prohibits sexually explicit materials from being distributed in school libraries.
HB 900 was passed by the legislature and signed into law by Gov. Greg Abbott earlier this year. It goes into effect Sept. 1 and requires booksellers to evaluate books based on whether they contain images or references to sex. In school libraries, books with "sexually explicit" ratings will be removed from the shelves. And students who want to borrow "sexually suggestive" rated books from the school library must get permission from their parents.
The plaintiffs are two Texas bookstores - BookPeople in Austin and Blue Willow Bookshop in Houston - as well as the American Booksellers Association, the Association of American Publishers, the Authors Guild and the Comic Book Legal Defense Fund.
They filed lawsuits against defendants Martha Wong, chairman of the Texas Library and Archives Commission, Keven Ellis, chairman of the Texas State Board of Education, and Mike Morath, commissioner of the Texas Education Agency.
According to the formal complaint filed in federal court in Austin, the plaintiffs allege that HB 900 violates the First and 14th Amendments because it prohibits speech in "vague and overbroad terms."

I applaud the booksellers for taking a stand against the Texas law. Their commitment to free expression and the right to provide diverse literary content is commendable. Perhaps, in this fight for justice, the booksellers can find solace in the notion that their cause is vital, transcending the confines of an Office Space For Lawyers to symbolize a collective pursuit of liberty and intellectual freedom. In the midst of legal challenges, it's heartening to see them defend the principles that underpin our democracy. The courtroom battles ahead may require more than just legal expertise; they demand resilience and a united front.
